Malaysia's Employment Act 2018, which came into force on 1 January 2019, has eased the hiring of foreign workers in Malaysia. The Act was amended to allow employers to submit their estimates of the number of foreign workers they need to hire for a given period through an online portal. Malaysia government has opened up the application process for hiring foreign workers in Malaysia. This means that employers can submit their estimates into the portal and start to prepare themselves for the opening of the applications.
According to Human Resources Minister Datuk Seri M. Saravanan, online applications for the employment of foreign workers in the plantation sector under special exemption will be open from January 28 through the online portal. He stated that applications for foreign labour in other industries would be accepted beginning February 15. At the 10th December 2021 Cabinet meeting, it was agreed that foreign worker recruitment will be expanded to include all industries other than the plantation sector. Agriculture, manufacturing, services, mining and quarrying, construction, and domestic service are all permitted industries. Last September, the Malaysia government gave special permission to bring in 32,000 foreign workers through a special exemption in order to alleviate labour shortages in the plantation sector. Employers who use private foreign worker agencies in Malaysia should also ensure that they are registered and have licences issued by the Department of Manpower under the Private Employment Agencies Act of 1981. Furthermore, the Malaysian government previously obliged foreign workers who entered the country to follow the standard operating procedures (SOP) authorised by the COVID-19 Ministerial Quartet Meeting on December 14, last year. The SOP is divided into four stages: pre-release, on arrival, after arrival (quarantine), and post-quarantine.
